Seven Suggestions to Successfully Implement The
California
Smoke-Free Workplace Act – Labor Code

1. Show clear support for the policy.
2. Post “NO SMOKING” signs at all
entrances as required by AB 13. Post the law on bulletin boards,
in the bar area, in the bathrooms… anywhere your patrons would
be likely to see it.
3. Make sure all employees are aware of the new
state law. Use information about the law as a payroll stuffer to
inform employees. Make sure each employee knows what he/she is responsible
to do to be in compliance with the law.
The following reasonable steps can be taken:
- Remove
all ashtrays
- Request
person smoking to refrain from smoking inside the enclosed workplace.
- Refer
to employer’s standard policy when dealing with behavioral
problems.
- If person
refuses to comply with smoking ordinance, request person to
leave premises, or refuse service to that person.
- Report
all problem cases to owner/manager.
4. Staff are not required to risk physical harm
to take reasonable steps toward implementation.
5. Focus on smoke, not the smoker. Designate
and prepare specific outdoor smoking sites. Provide containers for
discarded cigarettes.
6. Talk with your customers about the law. Prepare
them of the coming changes.
7. Call your local health department or city
code enforcement department for additional compliance support.
