City of Davis

Municipal Code Section 34.02.010. Prohibitin of Smoking in Places Accessible to the General Public

Smoking shall be prohibited in the following outdoor areas, except while
passing on the way to another destination, within 20 feet or building of or close enough
to the following areas for smoke to travel into an area or building, where
smoking is prohibited, whichever is greater.

  • Public events including, but not limited to, sports events, entertainment, speaking performances, ceremonies, pageants, and fairs
  • Seating provided by eating establishments and bars
  • Entrances and exits to enclosed public areas
  • Within the entryway of any enclosed public area
  • Stairways
  • Within courtyards and other areas where air circulation may be impeded by architectural, landscaping, or other barriers
  • Areas not open to the sky
  • Any place where people are using or waiting for a service, entry, or a transaction, including but not limited to ATMs, bank teller windows, telephones, ticket lines, bus stops, and cab stands
  • Any places where food and/or drink is offered for sale
  • Children's play areas
  • Public gardens
  • Open windows of any enclosed public area

9.14.25 Smoking Prohibited - Service Locations

Smoking is prohibited in all service locations, except while passing through the service area on the way to another destination. Service locations include those enclosed or unenclosed areas open to, used by, or accessible to the general public that are listed below:

  • Bus, train, and taxi shelters
  • Service waiting areas including, but not limited to, ticket or service lines, public transportation waiting areas, and public telephones
  • Areas within 20 feet of the entrance or wit to an enclosed public place that is closed between 10 P.M. and 6 A.M., or when the entrance or exit is for the exclusive use of employees and not accessible to the general public
  • Areas in dedicated parks or other publicly accessible areas that are within twenty feet of bleachers, backstops, or play structures


Rancho Cucamonga

Municipal Code Section 8.21. Smoking and Tobacco Use Regulated or Prohibited

8.21.155 Smoking Prohibited -- Entrances

Smoking shall be prohibited within an area measured 20 feet from the entrance of any
city or building or facility.

Any retail, non-profit, or service related business owner may choose to prohibit
smoking within 20 feet of the entrance to said business by conspicuously posting a no
smoking sign at or near the entrance to said business. Said sign shall reference this
ordinance and contain language similar to the following: "No smoking within 20 feet of
the entrance, pursuant to RCMC Section 8.21.155." When posting in accordance
with this provision, smoking within 20 feet of the entrance shall be prohibited. It shall
be the responsibility of any person smoking outside to ensure that smoke does not enter
any buildings through open windows or doors.

City of San Bernardino

Ordinance No. MC-1119 Use of tobacco products prhoibited-outdoor rectreation areas

Use of tobacco products shall be prohibited at any public sports and recreation facility, pool, sandbox, "tot lot", course, track, field, skate facility, or sports arena or stadium.

San Ramon

Ordinance No. 301 Section 2 Chapter IV, Smoking Regulations of Division B6, Health, Sanitations and Environmental Quality, of the Municipal Code

Section b6-73: Public Places--Prohibitions

Smoking shall be prohibited in the following places within the city:

  • Within all restaurants, including but not limited to indoor and outdoor dining areas,
    waiting areas, restrooms, offices, break rooms and food preparation areas.
  • Outdoor areas that are not separated by a reasonable distance from any entrance or
    exit to a place where smoking is prohibited.
  • Within, and for a reasonable distance (no less than 50 feet) surrounding, "tot-lots" where playground equipment has been installed for public use by children. Use of tobacco products of any kind is prohibited within such areas.

San Fernando

Ordinance No. 1525

Section 1: Smoking Prohibited

No person shall be in possession of a burning tobacco or tobacco-related product,
including but not limited to cigars and cigarettes, in or upon any park, playground or
recreation center.

No person shall chew tobacco or tobacco-related products, in or upon any park, playground or
recreation center.

No person shall dispose of lighted or unlighted cigars or cigarettes, or cigar or cigarette butts, or
any other tobacco-related waste in or upon any park, playground or recreation center.

No person shall intimidate, threaten any reprisal, or effect any reprisal, for the purpose of retaliating another person who seeks to obtain compliance with this section.

BERKELEY

Berkeley Municipal Code chapter 12.070, Section 12.70.030.U. A ban on smoking within 20 feet of entrances, exits and air intake vents of buildings open to the public.

Locations where smoking is prohibited:


Within 20 feet of any entrance, exit or air intake vent to any building that is open to the public, except while passing on the way to another destination. For purposes of this section, entrance or exit shall mean an opening into a building from a contiguous street, sidewalk, walkway or parking area, and "air intake vent" shall mean an opening into a building that draws in air form the outside as part of a building ventilation system but shall not include windows, entrances or exits.
